    Zimmerman is being railroaded according the greatest legal minds in the galaxy. (sarcasm) You should ignore the possibility that Zimmerman had neither any business or right to do what he did.

    an Information has been filed for charges with Murder in the Second Degree in Florida.

    Florida law defines second degree murder as:

    "The unlawful killing of a human being, when perpetrated by any act imminently dangerous to another and evincing a depraved mind regardless of human life, although without any premeditated design to effect the death of any particular individual, is murder in the second degree and constitutes a felony of the first degree, punishable by imprisonment for a term of years not exceeding life..."

    Second degree murder is a first degree felony punishable by life (1st PBL). If a firearm is used, 10-20-Life applies and the crime becomes a life felony with a 25-year mandatory minimum sentence.

    It is used in "Heat of the moment" sort of incidents where the alleged Defendant did not have the time to really consciously reflect upon the crime.

  • Isn't this whole thing going to boil down to whether the jury believes Zimmerman reasonably feared for his life or great bodily injury?

    It will be interesting to see how the prosecution tries to prove Zimmerman wasn't reasonably afraid for his life or limb. How would you guys argue that point?

    Typically when you are afraid for life and limb, you don't pursue the person you are afraid of. So there's that.

    So...if a handful of "marginal white guys" posted a placard and went on radio calling for the death of someone, you'd be cool with that? That's what we do with people when they call for someone's execution with a reward? That's what we do when their local leader goes on the publically owned airwaves and calls for his death and saying it's "time for blood in the streets" to defend their race?

    I don't care if it's 5, 500 or 5,000 people in that group...that type action needs to be EQUALLY investigated. If not, then they may resort to voter intimidation outside of polling venues...

  • Murder 2 requires beyond reasonable doubt. If prosecutors couldn't get charges to stick against OJ, I strongly doubt they get it to stick on Zimmerman.
